1. Acceptance of Terms

By downloading, installing, or using Breath Vitality ("the App"), you agree to these Terms of Use. If you do not agree, please do not use the App.

2. Description of Service

Breath Vitality is a wellness app for nervous system regulation through guided breathing exercises. The App is available for iOS and Apple Watch. It provides a Vitality Score, guided breathing exercises, HRV tracking, and related features.

3. Subscriptions & Payments

3.1 Free & Premium Content

Breath Vitality offers both free features and a premium subscription ("Breath Vitality Premium"). Some exercises and features are available only with an active subscription.

3.2 Subscription Plans

Premium subscriptions are available as monthly or annual plans. Current prices are displayed in the App and on the App Store before purchase.

3.3 Payment & Renewal

Payment is charged to your Apple ID account at confirmation of purchase.
Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
Your account will be charged for renewal within 24 hours prior to the end of the current period.
The renewal price equals the current subscription price.

3.4 Managing & Cancelling Subscriptions

You can manage or cancel your subscription at any time in your iPhone's Settings → Apple ID → Subscriptions.
Cancellation takes effect at the end of the current billing period — you retain access until then.
No refunds are provided for partial billing periods.

3.5 Free Trial

If a free trial is offered, it converts automatically to a paid subscription at the end of the trial period unless cancelled at least 24 hours before the trial ends. Any unused portion of a free trial is forfeited when you purchase a subscription.

3.6 Price Changes

We may change subscription prices at any time. You will be notified in advance via the App Store. Price changes take effect at the start of your next billing period.

4. Health Disclaimer

Breath Vitality is not a medical device and does not provide medical advice.

The App is intended solely for general wellness purposes.
The Vitality Score, HRV analysis, and nervous system state indicators are for informational purposes only and do not constitute a medical diagnosis.
Consult a physician before beginning any breathing exercise program, especially if you have cardiovascular, respiratory, or neurological conditions.
Hyperventilation exercises (CO2 Reset) should only be performed in a safe environment and with a companion.
Stop any exercise immediately if you feel dizzy, faint, or unwell.

5. User Responsibilities

You must be at least 16 years of age to use the App.
You are responsible for maintaining the security of your device and Apple ID.
You agree not to misuse the App or attempt to reverse-engineer it.

6. Intellectual Property

All content, design, code, and trademarks of Breath Vitality are the property of the developer. You may not copy, modify, or distribute any part of the App without written permission.

7. Data & Privacy

Your privacy is important to us. Please refer to our Privacy Policy for details on how data is handled. In summary: the App collects no personal data, health data stays on your device, and there is no tracking.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

The App is provided "as is" without warranties of any kind.
We are not liable for any damages arising from your use of the App.
We are not responsible for any health outcomes related to the use of breathing exercises.
Total liability is limited to the amount you paid for the subscription in the 12 months preceding the claim.

9. Third-Party Services

The App integrates with Apple HealthKit and optionally iCloud. These services are governed by Apple's terms. We are not responsible for the availability or functioning of third-party services.

10. Changes to Terms

We may update these Terms at any time. Continued use of the App after changes constitutes acceptance. Material changes will be communicated via the App or App Store.

11. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. For consumers within the EU, mandatory consumer protection provisions of your country of residence apply.
